Welcome to BANDSYNC ("we", "our", "us"). These Terms & Conditions ("Terms") govern your use of our mobile application BANDSYNC (the "App"). By using the App, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the App.

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this age requirement.

To access certain features of the App, you may need to create an account. You agree to provide accurate and complete information during the registration process and to update such information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree not to use the App to:

• Infringe the rights of any third party, including intellectual property, privacy, and publicity rights.
• Transmit any harmful or malicious code, including viruses, spyware, or malware.

You retain ownership of any content you upload, share, or create within the App ("Your Content"). By posting Your Content, you grant us a non-exclusive, worldwide, royalty-free license to use, modify, distribute, and display Your Content in connection with the operation of the App.

The App and its contents, including but not limited to text, graphics, images, and software, are the property of BANDSYNC and are protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of our content without our prior written consent.

The App may offer in-app purchases. All purchases are final and non-refundable, except as required by law. You are responsible for managing your in-app purchases and subscriptions through your device settings.

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding your personal information.

The App is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the App, including but not limited to the accuracy, reliability, or availability of the App. We disclaim all warranties to the maximum extent permitted by law.

To the fullest extent permitted by law, BANDSYNC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use the App.
• Any unauthorized access to or use of our servers and/or any personal information stored therein.
• Any bugs, viruses, or other harmful code that may be transmitted to or through the App.

You agree to indemnify and hold harmless BANDSYNC, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the App or violation of these Terms.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which BANDSYNC is based, without regard to its conflict of law principles.

We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on our website and updating the “Last Updated” date. Your continued use of the App after such changes constitutes your acceptance of the new Terms.
